SMS Terms and Conditions

These SMS Terms & Conditions (“SMS Terms”) govern your participation in the text messaging service (“SMS Service”) provided by Acute Rescue and Transport, Inc. (“Acute Rescue,” “we,” “us,” or “our”). By opting in, you agree to receive non-marketing, informational text messages and to be bound by these SMS Terms, as well as our general Terms of Use, Safety and Security Policy, Anti-Spam Policy, and Privacy Policy.

This SMS program complies with the Telephone Consumer Protection Act (TCPA) and the FCC’s 2025 guidelines.

1. Introduction

By opting in, you agree to receive recurring, non-marketing, informational SMS messages to the mobile number you provide. These messages may include:

  • Event medical coverage updates or correspondence
  • Operational notifications or correspondence
  • Account or payment related information
  • Service confirmations or alerts

Text messages will not contain Protected Health Information (PHI) or personal medical details in accordance with HIPAA regulations.

Your consent applies solely to Acute Rescue and Transport, Inc. and cannot be shared with or transferred to other businesses or third parties.

2. Opt-In Consent

Your participation requires explicit one-to-one consent via:

  • Web Form: Checking a clearly labeled SMS consent checkbox during online opt-in.
  • Verbal Consent: Providing affirmative agreement after hearing a compliant SMS disclosure read verbatim (recorded as required).

Note: Consent to receive messages is not a condition of purchasing any goods or services.

3. Message Frequency

Message frequency will vary based on your interactions with our services but will not exceed three (3) messages per day, unless an urgent operational update is necessary, or we are responding to a message received by you that requires a response.  Message and data rates may apply as determined by your mobile carrier and plan.

4. Opt-Out and Help Instructions

You may opt out at any time by:

  • Replying STOP to any message to unsubscribe.
  • Replying HELP for assistance.
  • Sending an email to info@acuterescue.com
  • Mailing a request to Attn:  SMS Opt Out, Acute Rescue and Transport, Inc., 6055 W. Corporal Ln., Boise, ID 83704

You’ll receive a confirmation of your opt-out, after which no further messages will be sent unless you opt back in.

5. HIPAA and Privacy Compliance

Acute Rescue and Transport, Inc. does not transmit Protected Health Information (PHI) via SMS.
All messages sent through this program are operational in nature and will never include medical diagnoses, treatment details, patient identifiers, or sensitive health data.

Our privacy practices are outlined in our Privacy Policy, and Safety and Security Policy, and we safeguard your mobile number and SMS activity data in accordance with HIPAA’s standards for operational communication.

6. Do Not Call (DNC) Compliance

We comply with all TCPA, FCC regulations, and Do Not Call (DNC) rules. If your number is registered on a national or state DNC list, you will not receive unsolicited marketing messages. All SMS communications are operational and initiated only with your explicit consent for the services described in these Terms.

7. Data Sharing and Record-Keeping

We do not sell, rent, or share your mobile number or SMS content with third-party marketers. Data may be shared internally or with contracted service providers solely for operational purposes.

We maintain records of:

  • Opt-in and opt-out dates and timestamps
  • Method of consent (web, paper, or verbal recording)
  • Message interaction history

These records are securely retained in compliance with HIPAA, TCPA, FCC, and applicable laws.

8. Privacy Policy

Your mobile number and related interaction data are handled in accordance with our Privacy Policy, and Safety and Security Policy. SMS data is used solely for operational messaging services as described in these Terms.

9. Message and Data Rates

Standard message and data rates may apply depending on your mobile plan. Acute Rescue and Transport, Inc. is not responsible for any fees billed by your mobile carrier.

10. Service Disclaimers and Limitations

We are not liable for delayed, undelivered, or unavailable messages. Delivery is subject to your carrier’s network availability, and SMS service may not be supported in all areas.

11. Changes to Terms

We reserve the right to update these SMS Terms at any time. Updates will be posted at www.acuterescue.com or sent via SMS if appropriate. Continued participation after any changes constitutes your acceptance of the revised Terms.
