Acute Rescue and Transport, Inc. (“Acute Rescue,” “we,” “us,” or “our”) is committed to protecting the privacy, security, and integrity of all personal, medical, and operational information entrusted to us. This Privacy and Security Statement explains how we collect, use, disclose, and safeguard your information in compliance with applicable federal and state regulations, including but not limited to the Health Insurance Portability and Accountability Act of 1996 (HIPAA), 2025 Telephone Consumer Protection Act (TCPA) guidelines, FCC regulations, and other applicable privacy and data security laws.

1. Information We Collect

We collect personal and operational information through our website, in person, via telephone, and through our SMS services, including:

  • Service and event requestsor inquiries
  • Payment or billing-related information
  • Consent records for SMS communications (see SMS Terms and Conditions)
    We do not collect or transmit Protected Health Information (PHI) via SMS services. PHI is only collected and used for operational and medical purposes via secure, HIPAA-compliant systems and channels.

2. Use of Information

Information collected is used solely to:

  • Respond to service, coverage, and account inquiries and form submissions
  • Process payments or account updates
  • Coordinate medical coverage for events
  • Provide non-marketing, operational SMS communications (with express, one-to-one consent)
  • Support operational and emergency management processes internally
  • Fulfill our legal and regulatory reporting obligations (including Medicare Advantage participation and CMS disclosures)

We do not sell, rent, or share your personal information or mobile number with third-party marketers.

3. SMS Communication Practices

In accordance with HIPAA and FCC/TCPA guidelines:

  • SMS messages are non-marketing, operational notifications only (e.g., appointment reminders, event updates)
  • No PHI is ever transmitted via SMS
  • One-to-one explicit consent is required for SMS participation
  • Message frequency is limited and subject to operational need
  • Clear opt-out instructions (text STOP) and help options (text HELP) are provided
  • Data rates may apply per your mobile carrier’s plan
  • Consent applies solely to Acute Rescue and Transport, Inc.

Records of SMS opt-ins, opt-outs, and consent timestamps are maintained in compliance with federal and state laws.

4. HIPAA and PHI Protection

Acute Rescue and Transport, Inc. fully complies with HIPAA regulations regarding the collection, use, disclosure, and safeguarding of Protected Health Information (PHI):

  • PHI is accessed, stored, transmitted, and disclosed only via HIPAA-compliant systems and processes.
  • PHI is never sent via unsecured or public messaging platforms, including standard SMS services.
  • Administrative, technical, and physical safeguards are in place to protect PHI from unauthorized access, use, or disclosure.

5. Offshore Disclosure and Authorization

In compliance with CMS guidelines and as a Medicare Advantage provider:

  • PHI may not be accessed, stored, transmitted, or disclosed beyond the jurisdiction of the United States without prior express written authorization from Acute Rescue and Transport, Inc.
  • If any Business Associate or subcontractor is engaged to provide services involving PHI access outside the United States, Acute Rescue ensures they meet the requirements of 45 C.F.R. §§ 164.502(e)(1)(ii) and 164.308(b)(2).
  • Names and countries of any offshore subcontractors involved in PHI-related services will be disclosed upon request.

6. Do Not Call (DNC) Compliance

We adhere to all applicable Do Not Call (DNC) rules under the TCPA and FCC regulations. If your phone number is registered on a national or state DNC list, you will not receive unsolicited marketing calls or texts from us. Operational messages are only sent with your express, recorded consent.

7. Data Sharing and Record-Keeping

Acute Rescue and Transport, Inc. does not sell or rent your personal information. Data may be shared internally or with contracted, HIPAA-compliant service providers solely for operational, medical, or regulatory compliance purposes.

  • All consent forms (web, paper, verbal recordings)
  • SMS opt-in and opt-out timestamps
  • Service interaction records
  • PHI disclosures and access logs (as required by HIPAA)

Records are securely retained in accordance with HIPAA, TCPA, FCC, CMS, and other applicable federal and state regulations.
