2. FCC Compliance

Acute Rescue operates in compliance with applicable Federal Communications Commission (FCC) regulations regarding the use of telecommunication and electronic communication platforms. Any communication tools provided through this Website, including contact forms and email inquiries, are intended for lawful and appropriate use only. By using these communication tools, you consent to receiving responsive communications from Acute Rescue regarding your inquiry or request.

3. Protected Health Information (PHI) and HIPAA Compliance

Any collection, use, transmission, or disclosure of Protected Health Information (PHI) by Acute Rescue is conducted in strict accordance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA), as amended, and its implementing regulations. PHI is collected only as necessary to provide services, manage account inquiries, process coverage requests, or fulfill other lawful business purposes.

Acute Rescue maintains administrative, technical, and physical safeguards to protect PHI against unauthorized access, use, or disclosure.

4. Offshore Disclosure and Written Authorization

In accordance with the Medicare Advantage program requirements and Covered Entity participation obligations:

  • Acute Rescue may collect or transmit information that includes PHI for Medicare beneficiaries as part of providing services.
  • Business Associates and subcontractors are prohibited from accessing, storing, sharing, maintaining, transmitting, using, or disclosing PHI via any medium with any individual or entity, including their own workforce or subcontractors, beyond the legal jurisdiction and boundaries of the United States, without prior express written authorization from Acute Rescue.
  • This restriction includes, but is not limited to, cloud storage, email, data hosting, or remote access systems located outside the U.S.

All access, use, and disclosure of PHI must comply with HIPAA regulations and applicable state and federal privacy laws.

5. Subcontractors and Agents

Acute Rescue acknowledges that its billing vendor, MedBill, may, from time to time, engage certain subcontractors located outside of the United States to perform services involving access to PHI under a Business Associate Agreement (BAA).

  • MedBill shall ensure that any permitted uses and disclosures of PHI conducted by such subcontractors are in full compliance with the terms of the BAA, HIPAA regulations, and 45 C.F.R. §§ 164.502(e)(1)(ii) and 164.308(b)(2).
  • Upon written request from Acute Rescue, MedBill will disclose the names of such subcontractors and the countries where services are being performed.
  • Acute Rescue reserves the right to review, audit, and restrict offshore subcontractor use as necessary to maintain regulatory compliance.

6. SMS/Text Communications

Acute Rescue may offer SMS/text message notifications or communications for appointment reminders, event medical coverage updates, or other operational messaging. By opting in to receive SMS communications from Acute Rescue, you acknowledge and agree to the separate Terms
